JOHN J. WINTER focuses his practice on creditors’ rights, commercial lending, foreclosure and bankruptcy, lender liability defense, real-estate, zoning, corporate formation and governance, and commercial litigation. Mr. Winter has represented lenders, including government-guaranteed lenders, as well as factors and portfolio investors, in connection with documenting and closing commercial loans, working out and collecting defaulted loans and factoring agreements, recovering and liquidating collateral, and handling environmental and title issues. He has also represented commercial landlords and tenants through lease negotiations and enforcement actions, condominium developers, as well as buyers and sellers of business assets. Mr. Winter helps his clients by being sensitive to their goals and objectives, building consensus with parties in interest, and working to maximize results while controlling costs.

Mr. Winter has successfully defended lender liability claims under Real Estate Settlement Procedures Act, Truth in Lending Act, Equal Credit Opportunity Act, and related consumer protection statutes. Mr. Winter has represented banks, commercial factors and trade creditors in connection with secured lending, loan documentation, and loan liquidations, as well as bankruptcy matters, including: stay relief, cash collateral and adequate protection issues; post-petition transactions, debtor-in-possession financing, asset sales, assumption/rejection of executory contracts; claims litigation; creditors’ committee formation and governance; professional retention and compensation; objections to exemptions and discharge; avoidance and turnover actions; plan disclosure, solicitation and confirmation issues.

Mr. Winter serves as partner and chairman of the creditors’ rights department at Chartwell Law. In addition to experience in lender liability, Mr. Winter has a broad history in recovery and liquidation of collateral, through replevin, attachment and garnishment. He also has notable experience in reviewing and negotiating commercial real estate leases.

As an author, Mr. Winter published the Fair Debt Collection Practices Act in Pennsylvania and the New Jersey Collection Law for the National Business Institute. In addition, he authored, “Commercial Loan Documentation in Pennsylvania; and Construction Contracts” for Lorman Education Services.

Mr. Winter has been an active board member for the Providence Animal Center from 2009-2018 and has served on the building committee. In his free time, Mr. Winter enjoys photography and cycling.
